real shot Terms of Service

Section 1 (Scope)

These Terms govern the use of the AI architectural image generation service "real shot" (the "Service") provided by Artistique Inc. ("we," "us," or the "Company"). Users shall use the Service upon agreeing to these Terms.

Section 2 (Definitions)

1. "User" means a corporation or individual that has applied to use the Service and has completed account registration.
2. "Content" means images uploaded to the Service by Users and images generated by the Service.
3. "Points" means the unit used to manage Service usage volume.

Section 3 (Account Registration and Usage Restrictions)

1. Any person wishing to use the Service (including users of the free trial) shall register an account through the form designated by the Company. Upon completion of account registration (or upon completion of payment in the case of paid plans), a usage agreement for the Service shall be deemed established, and the user may immediately begin using the features of the Service.
2. Notwithstanding the foregoing, the Company may, without prior notice, cancel the user's free trial, suspend the user's use of the Service, or forcibly terminate the user's account. The Company shall not be obligated to disclose the reasons therefor.
3. The above measures may be applied if it becomes apparent that the user falls under any of the following:
   • (1) Cases where false information is included in the application
   • (2) Corporations or individuals (including affiliated companies) whose business activities include the development or sale of AI image generation services, architectural CG production software, or similar services
   • (3) Cases where the Company determines that the user operates a business competing with the Service
   • (4) Cases of past violations of these Terms
   • (5) Any other cases the Company deems inappropriate

Section 4 (Free Trial)

1. The Company may offer a free trial to new Users for a specified period and under specified conditions.
2. Trial conditions (period, point allocation, available features) shall be determined separately by the Company.
3. If the User does not transition to a paid plan after the trial period ends, use of the Service will be suspended.

Section 5 (Fees and Payment)

1. Fees for paid plans shall follow the pricing schedule separately established by the Company.
2. Payment shall be made by credit card (processed via an external payment service designated by the Company).
3. Prices shown exclude consumption tax, which is added separately.
4. Paid fees are non-refundable for any reason, except where the Company has failed to provide the Service due to reasons attributable to the Company.

Section 6 (Points)

1. Points granted to each plan are reset each billing cycle. Unused points do not carry over to the next month.
2. Points purchased through add-on point packs shall be used within the billing cycle in which they were purchased.
3. Point consumption varies depending on the resolution used.

Section 7 (Cancellation)

1. Users may cancel at any time from the plan management screen within the Service.
2. Upon cancellation, Users may continue to use the Service until the end of the current billing cycle. Use of the Service will be suspended at the end of that period.

Section 8 (Content Rights)

1. The copyright of images uploaded by Users belongs to the User.
2. The copyright of images generated by the Service belongs to the User. Users may freely use, reproduce, and distribute generated images.
3. The Company may use images uploaded by Users and images generated by the Service, after anonymization, for the purposes of Service improvement and quality enhancement.

Section 9 (Prohibited Conduct)

Users shall not engage in any of the following conduct:

1. Analyzing, reverse engineering, or attempting to reproduce the technical mechanisms of the Service (prompts, algorithms, etc.)
2. Using the Service to develop a competing service
3. Transferring, lending, or sharing an account with a third party
4. Using the Service for purposes that violate laws or public order and morals
5. Placing excessive load on the Service's servers
6. Selling, providing for a fee, or licensing for a fee images generated by the Service as products to third parties (however, use in the User's own architecture or real estate business for sales materials, advertisements, social media posts, etc., does not fall under this prohibition)
7. Any other conduct the Company deems inappropriate

Section 10 (Service Modifications and Suspension)

1. The Company may modify, add to, or discontinue the Service without prior notice.
2. The Company may temporarily suspend the Service without prior notice in the following cases:
   • (1) For system maintenance or inspection
   • (2) When provision of the Service is difficult due to natural disasters, power outages, or other force majeure events
   • (3) Any other case the Company deems necessary

Section 11 (Disclaimers)

1. The Company makes no warranties regarding the accuracy, completeness, or fitness for a particular purpose of images generated by the Service.
2. The Company shall not be liable for any damages arising from use of the Service, except in cases of willful misconduct or gross negligence on the part of the Company.
3. If the Company is liable for damages, the amount of such liability shall be limited to the amount of fees paid by the User in the month in which the damages occurred.

Section 12 (Amendments)

1. The Company may amend these Terms as necessary.
2. Amended Terms take effect when posted on the Service.
3. If a User uses the Service after amendment, the User shall be deemed to have agreed to the amended Terms.

Section 13 (Governing Law and Jurisdiction)

1. The interpretation and application of these Terms shall be governed by the laws of Japan.
2. Any disputes related to the Service shall be subject to the exclusive agreed jurisdiction of the Tokyo District Court as the court of first instance.
